Not all laws come from a legislature. In many states, voters can directly propose or veto laws. This is a powerful tool for enacting Article II rights when elected officials drag their feet.
Types of Direct Democracy
Initiative
Citizens draft a proposed law (statute or constitutional amendment), gather enough voter signatures to place it on the ballot, and the people vote it up or down.
Example: Florida's "Amendment 4" restored voting rights to many ex-felons.
Referendum
The legislature passes a law, but citizens gather signatures to put it on the ballot for a public veto.
Example: A new tax law can be referred to voters before it takes effect.
Legislative Referral
The legislature itself places a question on the ballot, asking voters to approve something.
1 Find out if your state allows initiatives and referenda
Only 24 states have the full initiative process; many others allow only legislative referrals. NCSL has a state-by-state chart.
2 Learn the specific rules
Signature requirements vary wildly, often a percentage of the last gubernatorial vote. Deadlines are strict. The wording must be precise and often reviewed by a state board.
3 Start a citizens' committee
You'll need a formal campaign to gather signatures. This is field ministry on a massive scale. Every door knock is a chance to explain the Charter.
4 Work with existing networks
Many progressive organizations regularly run ballot initiative campaigns. Our movement can partner or lead.
